Until the 15th century, the preservation of documents was entrusted to the notary. Starting with the Aragonese period, following the 1477 decree by Ferrante d’Aragona, regulations were introduced to formalize the preservation of these documents, a practice later continued by the Bourbon rulers. During the Napoleonic period, stricter legislation was enacted (1809), leading to the establishment of a general notarial archive for each province.
Preservation of Notarial Archives became mandatory with Presidential Decree No. 1409 of 1963, which required their transfer to the relevant State Archives after 100 years from the end of activity of individual notaries.
